Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the VibeChef mobile application and related websites, emails, and services (collectively, the "Services") provided by Subspace Revolution, Inc., 1111B S Governors Ave, STE 25931, Dover, DE, 19904, United States ("Subspace Revolution," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
Not medical or nutrition advice. VibeChef provides informational recipe and pantry features only and does not provide medical, nutritionist, or dietitian advice. Always consult qualified professionals regarding dietary needs, allergies, or health conditions.
1. Eligibility & Accounts
- Eligibility. You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you must have your parent or legal guardian’s permission.
- Account creation. You may create an account by providing a valid email address and, optionally, your first and last name. You agree to provide accurate information and to keep it up to date.
- Account security. You are responsible for safeguarding your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
- Termination. We may suspend or terminate your access (with or without notice) if you violate these Terms or if required by law. You may stop using the Services at any time and can request account deletion as described in our Privacy Policy.
2. User Content & Acceptable Use
- User Content. You may create, upload, post, or otherwise make available text, images, and other materials ("User Content"). You retain ownership of your User Content.
- License you grant to us. You grant Subspace Revolution a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to host, store, reproduce, display, perform, adapt, and distribute your User Content solely to operate, improve, and promote the Services.
- Your promises. You represent and warrant that you have all rights necessary to grant the above license, and that your User Content and use of the Services will not:
- infringe or violate any third‑party rights (including copyright, trademark, privacy, or publicity);
- contain illegal, harmful, defamatory, obscene, or deceptive content;
- include personal data of others without their consent;
- include medical, nutritional, or safety claims presented as professional advice; or
- attempt to reverse engineer, disrupt, or harm the Services.
- Moderation. We may (but are not obligated to) review, remove, or disable access to User Content that violates these Terms or applicable law.
3. Intellectual Property
- Our rights. The Services, including all content we provide (e.g., software, features, designs, logos, visual design, and trademarks), are owned by or licensed to Subspace Revolution and are protected by law. We reserve all rights not expressly granted.
- License to you. Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to download and use the App on a device you own or control solely for your personal, non‑commercial use.
- Feedback. If you send ideas, suggestions, or feedback, you grant us a perpetual, worldwide, royalty‑free, irrevocable license to use and exploit them without compensation or attribution.
4. Copyright & Infringement (DMCA)
If you believe content on the Services infringes your copyright, please send a notice to support-vibechef@subspace.team with:
- your contact information, 2) identification of the work claimed to be infringed, 3) identification of the allegedly infringing material and its location, 4) a statement of good‑faith belief that use is not authorized, 5) a statement that the information is accurate and, under penalty of perjury, you are the owner or authorized to act, and 6) your signature. We may, in appropriate circumstances, remove or disable content and terminate repeat infringers.
5. Subscriptions & Free Trials
- Subscriptions. We offer optional subscription plans that unlock premium features ("Subscriptions"). Details (features, pricing, term) will be presented at sign‑up within the Services.
- Billing & renewal. Subscriptions auto‑renew at the end of each term unless you cancel before renewal. Taxes may apply. Pricing and features may change; any changes will apply to the next billing cycle after notice where required.
- Free trials. If you start a free trial, you will be charged at the end of the trial unless you cancel before it ends. Eligibility for trials may vary and is at our discretion.
- Cancellation and refunds. You can cancel your subscription at any time through your account settings or per the cancellation procedures of the platform through which you subscribed (Apple App Store or Google Play). After cancellation, you retain access to premium features until the end of the current paid period. Subscriptions purchased through the Apple App Store or Google Play are subject to the refund and cancellation policies of those platforms. To request a refund for purchases made through these platforms, you must contact Apple or Google directly according to their respective policies. We do not control and are not responsible for refunds processed by third-party platforms. Except as required by applicable law or the app platform's refund policy, no refunds will be provided for partial subscription periods.
- No goods or one‑off purchases. We do not sell physical goods or one‑time in‑app items.
6. Promotions, Contests & Sweepstakes
We may run promotions, contests, or sweepstakes from time to time. Each will be governed by separate Official Rules that will prevail in the event of a conflict with these Terms. Promotions are void where prohibited.
7. Third‑Party Services
The Services may integrate or link to third‑party services (e.g., analytics, authentication, hosting). Those services are subject to their own terms and privacy policies, and we are not responsible for their actions or omissions.
8. Health, Nutrition, and Safety Disclaimer
Recipes, ingredient suggestions, and dietary tips are for informational purposes only and may not account for your personal circumstances, allergies, or dietary restrictions. You are solely responsible for reading labels, checking for allergens, and practicing safe food handling. To the maximum extent permitted by law, we disclaim liability for adverse outcomes related to food choices, preparation, or consumption.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBSPACE REVOLUTION, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) US$50 OR (B) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY.
Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Subspace Revolution and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your breach of these Terms; or (d) violation of any law or third‑party right.
12. App Platforms
If you downloaded the App from the Apple App Store or Google Play:
- You acknowledge that these Terms are between you and Subspace Revolution, not with Apple or Google, and that Apple/Google are not responsible for the App or its content.
- Apple/Google have no obligation to furnish maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple/Google; to the maximum extent permitted by law, Apple/Google will have no warranty obligation whatsoever with respect to the App.
- You represent that you are not located in a country subject to U.S. government embargo or designated as a “terrorist supporting” country and are not listed on any U.S. government list of prohibited or restricted parties.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Services.
14. Changes to the Services and to These Terms
We may enhance, modify, or discontinue parts of the Services at any time. We may also update these Terms from time to time. The “Effective date” above indicates when these Terms were last updated. If changes are material, we will provide notice as required by law. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
15. Miscellaneous
- Severability. If any provision is held invalid, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement. These Terms (and any policies referenced, including our Privacy Policy) are the entire agreement between you and us regarding the Services.
- Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
